SETTLEMENT ENTRY CLEARANCES FOR THE FIANCE(E)S OF PEOPLE
SETTLED IN THE　UNITED KINGDOM
This information sheet explains the application procedure for people who plan to marry
in the United Kingdom and then stay there for permanent residence. The fiance(e) must
be a British Citizen or a person with “indefinite leave to remain” (permanent residence)
in the UK.

A) DO I NEED AN ENTRY CLEARANCE?
If you plan to go to the United Kingdom to get married and then leave shortly thereafter
to live permanently elsewhere, you may enter the country as a “Visitor for Marriage.”
Such visitors who are Japanese citizens do not require any form of prior entry clearance
to enter the United Kingdom. However they should make clear to the Immigration Officer
on arrival that they intend to marry in the UK but not settle there. Visitors are not allowed
to work during their stay and are only eligible for emergency treatment under the National
Health Service.

If you do intend to settle in the United Kingdom with your spouse after marriage, you must
apply for a settlement visa before you travel, as visitors are not allowed to switch to
a different immigration status once in the United Kingdom.

B) WHAT ARE THE REQUIREMENTS FOR A FIANCE(E) SETTLEMENT ENTRY CLEARANCE?
You must be able to satisfy the entry clearance officer that:
1. You are seeking leave to enter the United Kingdom for marriage to a person present and
settled in the United Kingdom or who is on the same occasion being admitted for settlement
(British Citizens who have been living abroad but who are returning to live in the United
Kingdom are treated as present and settled on arrival); and
2. You and your fiance(e) have met; and
3. Each of you intends to live permanently with the other as his or her spouse after
the marriage; and
4. Adequate maintenance and accommodation without recourse to public funds will be
available for you until the date of the marriage; and
5. There will, after the marriage, be adequate accommodation for you both and any dependants
without recourse to public funds in accommodation which you own or occupy exclusively; and
6. You will be able after the marriage to maintain yourselves and any dependants adequately
without recourse to public funds.

C) HOW CAN I APPLY FOR AN ENTRY CLEARANCE?
Applications should be made to the Visa Section of the British Embassy in Tokyo
(there are no entry clearance facilities at the Consulate-General in Osaka).
If you are not a resident of Japan, you must apply to a British mission in a country
where you are normally resident or of which you are a national.
Please complete application forms IM2A and IM2B (available from the Embassy
by mail or in person, or can be downloaded from
http://www.fco.gov.uk/travel/download.asp).
NB: Please check that you have signed and dated the application forms - your signature
should match the one found on your passport.
Return the forms to this office together with:
1. Your passport (and previous passports);
2. * Your fiance(e)’s passport.( If sending a certified copy, please send the data pages
plus any pages showing immigration stamps to Japan or any other countries);
3. An original letter from your fiance(e) stating when s/he wishes to marry you,
that's/he is free to marry (if your fiance(e) has been married before,
we need to see the original decree absolute), and that s/he wishes you to live with
him/her in the United Kingdom. The letter should be addressed to the British Embassy,
Visa Section;
4. * Evidence that you will be able to support and accommodate yourselves before marriage
and thereafter as a couple without recourse to public funds;
5. An original family register (koseki-tohon);
6. 2 recent passport-size photographs;
7. The equivalent of GBP 240 entry clearance fee (payable in yen, in cash).

A certified copy is one properly certified as a true copy by a solicitor or notary public.

D) WHAT DOCUMENTS SHOULD I SUBMIT TO DEMONSTRATE ADEQUATE ACCOMMODATION AND MAINTENANCE ARRANGEMENTS IN THE UK?
The circumstances of every couple are different, and it is therefore
difficult to give hard and fast guidelines. As the onus is on the applicant to satisfy the requirements, we suggest that you provide as much documentation as you can so that
we do not have to delay your application by requesting more. Information submitted for
an entry clearance application is treated confidentially. The following documents will assist
the entry clearance officer in assessing your application:
1. Maintenance: ( Please provide as much information as possible.)
1.1. *A letter confirming employment from your fiance(e)’s employer and/or from your
potential employer in the UK stating the salary;
1.2. * Evidence of your funds and those of your sponsor ( original updated bank books
or monthly bank statements for the last six months. A certificate of balance is not acceptable);
NB If neither you nor your sponsor have employment arranged in the UK, you should submit original CVs (in English) giving your work experience and qualifications;
2. Accommodation:
2.1. *A letter from a building society or bank stating that you or your sponsor hold a
mortgage on a property;
2.2. * A tenancy agreement naming you and your sponsor as the legal
occupiers;
2.3. Shared accommodation in somebody else’s property (e.g. in your
sponsor’s parent’s house) is only acceptable if it is of a short-term nature.
NB
The legal occupier should write a letter guaranteeing accommodation and enclose
evidence that they have the accommodation to offer, e.g. an original tenancy agreement
or proof of mortgage (plus a photocopy). If the occupier lives in a council house, the ermission
of the council must be obtained.
* Please provide either the original documents and one photocopy, or a certified copy.
A certified copy is one properly certified as a true copy by a solicitor or notary public.

E) DO I HAVE TO COME TO THE BRITISH EMBASSY IN PERSON?
You will normally be required to attend an interview. This might not be possible on the day
you apply, although you will be offered the first available appointment.
Otherwise, you may submit your application by registered post. (The　Application,
including the fee in cash, should be sent by cash registered mail or “genkin kakitome”).
We reserve the right to call an applicant for interview in person. Postal applicants should
allow a minimum processing time of at least four to five weeks, longer at peak holiday periods.
We strongly recommend that you allow plenty of time to avoid having to delay travel.
Please note that the Embassy cannot give any guarantees in advance of an application
being submitted and a fee for entry clearance being paid that an Entry Clearance will be
issued in a particular application. The onus is on an applicant to demonstrate to the Entry Clearance Officer’s satisfaction that s/he meets the requirements of the category of Entry
Clearance applied for. For this reason we advise all applicants not to make firm travel plans
in advance of obtaining an entry clearance.

F) IS THERE ANYTHING ELSE I SHOULD BE AWARE OF?
The Embassy is located near the Imperial Palace and is a couple of minutes walk from
Hanzomon Station on the Hanzomon line (Exit 4). All applications made in person must be
submitted between 9 and 11 am.
The visa you will be issued with as a fiance(e) is valid for six months. You must get married
during this time, and you will not be allowed to work until you are married. Once married,
you should apply to the Immigration and Nationality Department of the Home Office to
change to a 12 month residence permit for spouses. After you have been living with your
spouse in the UK for one year, you may apply for “indefinite leave to remain.” This allows
you to stay permanently in the United Kingdom, although such status may be lost if you
live outside the country for more than two years.
